Inquiry Concluded
- 9 October 2024– Mrs Kylie Garaty – Harness Racing New South Wales (HRNSW) Stewards conducted an Inquiry into a report received from the Australian Racing Forensic Laboratory (ARFL) that Scopolamine and Atropine were detected in the urine sample taken from YESNOMAYBESO following its win in race 8, the GARRARDS HORSE AND HOUND PACE (2030 metres) conducted at Newcastle on Monday 29 January 2024.
The reserve portion and control solution were confirmed by Racing Analytical Services Limited (RASL) in Victoria.
Mrs Garaty pleaded guilty to a charge issued against her pursuant to Australian Harness Racing Rule (AHRR) 190 (1), (2) & (4)
In respect of that charge, pursuant to AHRR 256(6) Stewards determined that a conviction would be recorded, however, Stewards did not impose a penalty on Mrs Garaty as they were satisfied to the requisite standard that the detection of scopolamine and atropine had resulted from contaminated feed and/or plants having been ingested by the horse YESNOMAYBESO.
Having considered submissions in relation to the horse and AHRR 195, HRNSW Stewards disqualified YESNOMAYBESO from the abovementioned race.
Mrs Garaty was advised of her right to appeal the decision of HRNSW Stewards to disqualify her horse.
Mrs Garaty was also cautioned that she must take all reasonable measures in future to manage her training establishment and horses to ensure that her horses are presented in accord with the Rules.
Appeal Decisions
- 9 October 2024 – Mr Aaron Goadsby appealed the decision of the NSW Harness Racing Appeal to dismiss a previous appeal after HRNSW Stewards disqualified him for a period of 3 months after he pleaded guilty to a charge issued pursuant to AHRR 190(1), (2) & (4) following a report from the Australian Racing Forensic Laboratory (ARFL) that Phenylbutazone, oxyphenbutazone and gamma-hydroxyphenylbutazone were detected in the post-race urine sample taken from LUVARESCHS following its win in race 8, the HRNSW GUARANTEED 2YO PACE (1609 metres) conducted at Newcastle on Friday 26 May 2023.
By decision of the NSW Racing Appeals Tribunal, the appeal was dismissed. Mr Goadsby has filed a summons in the NSW Supreme Court for Judicial Review of that decision.
- 21 October 20 2024 – Mr Lleyton Green appealed the decision of the NSW Harness Racing Appeal Panel to dismiss an appeal after HRNSW Stewards suspended his driver’s licence for a period of 21 days after he was found guilty of a charge issued pursuant to AHRR 163(1)(a)(iii) when driving the horse BERTIE JONES NZ in Race 9 at Tabcorp Park Menangle on Tuesday 9 July 2024.
By decision of the NSW Racing Appeals Tribunal, the appeal was upheld and the suspension set aside.
- 25 October 2024 – Mr Scott Wade appealed the decision of the HRNSW Stewards to disqualify him for a period of 1 year and 10 months after he pleaded guilty to a charge issued pursuant to AHRR 190(1), (2) & (4) following a report from the Australian Racing Forensic Laboratory (ARFL) that Levamisole was detected in the post-race urine sample taken from CHANGE OF MIND following its win in Race 6, the SKY RACING ACTIVE PACE (2125 metres) conducted at Penrith on Thursday 5 January 2023.
By decision of the NSW Harness Racing Appeal Panel, the appeal was dismissed and the period of disqualification confirmed. Mr Wade has appealed that decision to the NSW Racing Appeals Tribunal.
Integrity Information
- During the month of October 2024, HRNSW Integrity department obtained 825 race day samples.
As per normal HRNSW procedure all samples have been submitted for analysis.
