On Tuesday 10th September 2024 HRSA Stewards inquired into reports from Racing Analytical Services Ltd. Victoria that Caffeine and Theophylline had been detected and subsequently confirmed by the Australian Racing Forensic Laboratory N.S.W. in the Blood Sample taken from Treacherous Rock prior to it competing in and winning Race 6 Hygain Micrspeed Pace run at Globe Derby Park on Saturday 18th May 2024.

Further the inquiry addressed the reports from Racing Analytical Services Ltd. Victoria that Caffeine and its Metabolites, Theophylline, Paraxanthine and Theobromine had been detected and subsequently confirmed by the Australian Forensic Laboratory N.S.W. in the Blood Sample taken from Treacherous Rock prior to it competing in and running second Race 6 Ladbrokes Easy Form Pace run at Globe Derby Park on Monday 1st July 2024.

At today’s inquiry evidence was taken from Dr. Adam Cawley RASL Scientific Manager in respect to analysis of the samples and from Dr. Dan Sims HRSA Veterinary Consultant as to the classification of the substances under AHRR relating to prohibited substances.

Trainer Dean Girardi explained his treatment and preparation of Treacherous Rock along with an examination of his log book was unable to provide a plausible explanation to assist the inquiry as to reasons for Analysts reports.

Charges were issued against Mr. Girardi under AHRR 190(1)(2) and (4)

Charge 1. That as Trainer of Treacherous Rock he had presented the gelding at Globe Derby Park on Saturday 18th May 2024 in Race 6 Hygain Micrspeed Pace in which it finished first not free of prohibited substances.’

Charge 2. That as Trainer of Treacherous Rock he had presented the gelding at Globe Derby Park on Monday 1st July 2024 in Race 6 Ladbrokes Easy Form Pace in which it finished in second place not free of prohibited substances.”

Mr. Girardi pleaded guilty to both charges.

After giving due consideration of an address from Mr. Girardi on penalty, considering the guilty pleas, previous record in relation to offences under this Rule and the classification of the prohibited substances under HRSA guidelines the following penalties were imposed.

Charge 1. Fine $2,750 with $750 Suspended providing no breach of the Rule for a period of Two (2) Years.

Charge 2. Fine $2,750 with $750 Suspended providing no breach of the Rule for a period of Two (2) Years.

Mr. Girardi was also directed that he pays $600 towards the cost of the confirmatory Analysis of the Samples.

Furthermore, in accordance with AHRR 195 Treacherous Rock was disqualified as winner Race 6 Globe Derby Park 18th May 2024 and second placegetter in Race 6 Globe Derby Park 1st July 2024.

The stand down from racing was removed off Treacherous Rock.

Stewards advised Mr. Girardi of his right to appeal the findings.
